Terms of Service

1. Introduction

Welcome to Finds. These Terms of Service ("Terms") govern your use of the Finds mobile application ("App") operated by Finds ("we", "us", "our"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

We may update these Terms from time to time. If we make material changes, we will notify you through the App. Your continued use after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years old to use Finds. By creating an account, you confirm that you are 18 or older and that all information you provide is accurate and truthful. We reserve the right to request proof of age or identity at any time and to suspend or terminate accounts that do not meet these requirements.

3. Your Account

3.1 Account Creation

You must create an account to buy, sell, or use most features of the App. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at contact@getfindsapp.com if you suspect unauthorised access to your account.

3.2 Account Information

You agree to provide accurate, current, and complete information when creating your account and to update it as necessary. You may not impersonate another person, use a misleading username, or create multiple accounts for deceptive purposes.

3.3 Account Suspension and Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, receive repeated complaints from other users, or for any other reason we deem necessary to protect the Finds community. You may delete your account at any time through the App settings.

4. The Finds Marketplace

4.1 What Finds Is

Finds is a peer-to-peer marketplace that connects buyers and sellers of home goods, vintage items, antiques, furniture, art, lighting, ceramics, textiles, kitchenware, and other items for the home. Finds is a platform only — we are not a party to any transaction between buyers and sellers.

4.2 What You Can Sell

Finds is exclusively for home goods and interiors items. Permitted categories include Furniture, Lighting, Decorative Objects, Glassware and Ceramics, Wall Art and Mirrors, Textiles and Soft Furnishings, Kitchenware, Bathroom items, Storage and Organisation, and Vintage Collections and Curios.

5. Selling on Finds

5.1 Creating Listings

When you create a listing, you must provide accurate and honest information, including photos that truthfully represent the item, an accurate description of the item's condition, the correct category and relevant details (era, style, material, etc.), and a fair and honest price. You must upload a minimum of 4 and a maximum of 12 photos per listing.

5.2 Listing Fees

There are no fees to list items on Finds. Sellers keep 100% of the sale price. We do not charge commission on sales.

As a seller, you agree to:

Sellers are responsible for arranging shipping and setting the shipping price on their listings. Sellers choose the courier and shipping method. After dispatch, sellers must select the courier used and provide a tracking number through the App. Sellers must dispatch items within 6 days of a completed sale. Failure to dispatch within this timeframe may result in the order being cancelled and the buyer receiving a full refund.

5.5 Offers and Split the Ship

Buyers may send price offers on listings. Alongside a price offer, buyers may propose how shipping costs are shared: buyer pays full shipping, shipping split 50/50 between buyer and seller, or seller covers full shipping.

The shipping split option is only available on items where shipping costs exceed £10. For shipping under £10, the buyer pays the listed shipping price.

Sellers may accept, decline, or counter any offer. Sellers may also configure automatic acceptance rules for offers that meet specified price and shipping split criteria.

An accepted offer creates a binding agreement between buyer and seller.

5.6 Cancellations by Sellers

If you are unable to fulfil a sale after accepting an offer or receiving a purchase, you must cancel the order through the App as soon as possible. The buyer will receive a full refund. Repeated cancellations may result in account restrictions or suspension.

6. Buying on Finds

6.1 Purchasing Items

When you purchase an item or your offer is accepted, you enter into a binding agreement with the seller. Payment is processed immediately at the point of purchase.

6.2 Purchase Protection Fee

A purchase protection fee is charged on every transaction. This fee is 5% of the item price plus a £0.50 fixed fee, capped at a maximum amount for higher-value items. The fee covers secure payment processing, fraud protection, customer support, and our purchase protection policy. The fee is clearly displayed at checkout before you complete your purchase.

6.3 Payment Methods

You can pay using a saved debit or credit card, a new card entered at checkout, Apple Pay, or Google Pay. All payments are processed securely through Stripe.

As a buyer, you agree to:

6.5 Confirming Delivery

After an item is delivered, you should inspect it and either confirm that it is as described or report an issue. If you confirm the item is satisfactory, payment is released to the seller's balance. If you do not confirm or report an issue within 5 days of delivery confirmation by the courier, payment will be automatically released to the seller.

6.6 Reporting Issues

If an item is significantly not as described, damaged during shipping, or does not arrive, you may open a dispute through the App. We will review the case and may issue a full or partial refund at our discretion. Minor variations from the listing description (for example, slight colour differences due to photography) do not constitute grounds for a dispute.

7. Payments, Balance, and Withdrawals

7.1 Payment Processing

All payments are processed through Stripe. By using Finds, you agree to Stripe's Terms of Service and Privacy Policy. We do not store your full payment card details.

7.2 Stripe Connected Accounts

By registering as a seller on Finds, you agree to be bound by the Stripe Connected Account Agreement, which includes the Stripe Terms of Service as modified from time to time. Stripe may independently collect and process your personal data, including identity verification documents, in accordance with their own privacy policy. You authorise Finds to share your information with Stripe to the extent necessary to facilitate payments, payouts, identity verification, and fraud prevention.

7.3 Seller Balance

When a buyer confirms delivery or the automatic release period expires, the sale amount (minus any shipping costs borne by the seller under a shipping split arrangement) is credited to the seller's balance.

7.4 Withdrawals

Sellers may withdraw their available balance to a linked bank account. You must provide accurate bank account details. Withdrawal processing times may vary but are typically completed within 3-5 business days. We reserve the right to delay or withhold withdrawals if we suspect fraudulent activity or if there are unresolved disputes on your account.

7.5 Taxes

You are responsible for determining and paying any taxes applicable to your transactions on Finds, including income tax and VAT where applicable. Finds does not provide tax advice. If you are selling regularly or commercially, you may have obligations to register as a trader and comply with consumer protection regulations.

8. The Scout Map

8.1 How It Works

The Scout Map allows users to pin items they have spotted in physical shops, charity shops, antique centres, and markets for other users to discover. This is a community feature — Finds does not sell these items and is not involved in any transaction that may occur at a physical shop.

When marking a find on the Scout Map, you agree to:

Finds does not guarantee that items pinned on the Scout Map are still available, accurately described, or priced as stated. The Scout Map is a community tool and relies on user contributions. Items may be sold, moved, or removed at any time. Finds accepts no liability for any loss or disappointment arising from Scout Map pins.

9. Events

9.1 Event Listings

Finds may list local flea markets, vintage fairs, car boot sales, and other events. Event information is provided for informational purposes only. We do not organise or control third-party events unless specifically stated.

9.2 Event Reviews

Users may rate and review events. Reviews must be honest, based on genuine attendance, and not defamatory or abusive.

10. Stories

Users may post photos and videos to their stories on the App. Story content must comply with our content guidelines (Section 12). We reserve the right to remove story content that violates these Terms.

11. Ratings and Reviews

11.1 Leaving Reviews

After a completed transaction, the buyer may leave a rating (1-5) and a written review for the seller. Reviews must be honest, fair, and based on the actual transaction experience.

11.2 Prohibited Review Content

Reviews must not contain personal attacks or threats, discriminatory or offensive language, false or misleading claims, advertising or spam, personal information about the other party, or content unrelated to the transaction.

11.3 Review Removal

We reserve the right to remove reviews that violate these Terms. We do not remove reviews simply because a user disagrees with the rating or feedback given.

12. Content Guidelines

12.1 Your Content

You retain ownership of any content you post on Finds (photos, descriptions, messages, reviews, Scout Map pins, stories). By posting content, you grant Finds a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute your content in connection with operating and promoting the App.

12.2 Prohibited Content

You must not post content that is illegal, fraudulent, or deceptive; infringes intellectual property rights; is defamatory, abusive, threatening, or harassing; contains hate speech; is sexually explicit; contains malware or spam; promotes illegal activity; or is otherwise objectionable at our sole discretion.

13. Intellectual Property

The Finds name, logo, branding, design, and all associated intellectual property are owned by us. You may not use our intellectual property without our prior written consent. You retain ownership of the content you create and post on Finds.

15. Limitation of Liability

Finds is a platform that connects buyers and sellers. We are not a party to transactions between users. We do not own, inspect, or verify items listed on the App.

The App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App's reliability, availability, or fitness for a particular purpose.

To the maximum extent permitted by law, Finds shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the total fees you have paid to Finds in the 12 months preceding the claim.

Nothing in these Terms affects your statutory rights as a consumer under UK law.

16. Disputes Between Users

If a dispute arises between a buyer and seller, we encourage both parties to communicate through the App. If a resolution cannot be reached, either party may escalate to Finds for review. Our decision is final. If a buyer initiates a chargeback instead of using our dispute process, we reserve the right to suspend their account.

17. Indemnification

You agree to indemnify and hold harmless Finds from any claims, liabilities, damages, losses, or expenses arising out of your use of the App, your violation of these Terms, your listings or transactions, your content, or your violation of any rights of another person.

18. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

19. Severability

If any provision of these Terms is found to be unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and Data Policy, constitute the entire agreement between you and Finds regarding your use of the App.
